Presentation Title: Legal Ethics in a Legal Maze: Advising Clients in an Evolving Regulatory Environment

Description

This course will focus on the ethical challenges created by the breadth and complexity of the health care regulatory framework.  The presentation will review a couple notable historical care enforcement actions and examine the tension inherent in RPC 1.2(d) between advising the client as to the parameters of the law and the prohibition on aiding a client’s illegal conduct.   The second half of the presentation will focus on the 2019 SCOTUS Allina opinion, its implications when advising clients on sub-regulatory guidance and the lawyer’s obligations to provide clients informed advice.  Finally, this course will suggest practical tips for lawyers to avoid ethical pitfalls when advising clients in an evolving regulatory environment.
